Every year, assets which have been gathered over an individual's lifetime are distributed in ways their owner never intended or desired. Misunderstandings and disputes arise among family members and thousands of dollars are paid in unnecessary legal fees and taxes. The reason? People fail to take the time to meet with an experienced lawyer to ensure appropriate Estate Planning is done and documented.

Every adult should arrange for a Will to be prepared which reflects his or her individual circumstances and goals. In addition to appointing an Executor and a Guardian for your children, a Will outlines the manner in which your assets are to be distributed. Due to the pace at which our lives and the law changes, your Will, once prepared, should be reviewed on a regular basis.

Planning for incapacity, whether as a result of accident or sickness, is also an important aspect of Estate Planning. An Enduring Power of Attorney provides for the ongoing financial maintenance and care of yourself and your loved ones should you become incapacitated. If you fail to have this critical tool of Estate Planning prepared prior to incapacity, your financial affairs might well be governed and monitored by the Courts. Obviously this is a very impersonal and expensive course of action and one that is unlikely to meet your needs or your family's.

Brownlee LLP has an experienced Wills and Estates Department that would be pleased to discuss your specific circumstances and concerns with you.
